Resumen

El Derecho de los negocios internacionales es testigo de una creciente preferencia hacia las cláusulas escalonadas multifunción para el arreglo de controversias (MTDRCs) debido a la naturaleza adaptable de tales procesos en una amplia gama de conflictos. Sin embargo, la falta de claridad sobre su aplicabilidad persiste en algunas jurisdicciones. En este estudio se analiza la naturaleza conceptual de las cláusulas de varios niveles y se detallan los beneficios de las mismas. Pese a algunos problemas de funcionamiento estas cláusulas han llegado a ser reconocidas como un método comúnmente aceptado para la solución de las controversias en los contratos comerciales, particularmente en los contratos de construcción.
