Resumen

This study is aimed to take stock of the decade of the policy of the EU directed to develop a unified policy on migration concerning the attraction of the highly-skilled workers. Basically, it deals with the challenges that has faced the EU instrument known as “Blue Card” established by the Council Directive 2009/50/EC, of 25 May 2009, on the conditions of entry and residence of third-country nationals for the purposes of highly qualified employment. In 2016, the European Commission presented a proposal to repeal the aforementioned Directive and provided for an improved regulation, taking into account the impact assessment and the follow up of implementation of the Directive 2009/50/EC in the EU Member States. The practice of European countries in this respect has been affected by the priorities of national policies and, in particular, by the situation of labour markets due to the economic and financial crisis following the adoption of the instrument currently in force. The latest negotiation results at European level have highlighted the opposition between the need for a harmonized approach and the national interests.
