El capítulo laboral del CPTPP¿hacia Un nuevo paradigma de la cláusula social?

Resumen

En la segunda década del siglo XXI, se ha discutido con insistencia de las llamadas “agrupaciones megarregionales” y los correspondientes procesos de negociación y firma de los acuerdos “megarregionales” o “de nueva generación”. Uno de ellos, a saber, el Acuerdo Global y Progresivo para la Asociación Transpacífica (CPTPP o TPP-11) constituye el objeto de este estudio. Al igual que su predecesor, el Acuerdo Transpacífico (TPP), contiene un extenso Capítulo 19, titulado “Trabajo”, que consta de 15 artículos, y que representa un ejemplo de la cláusula social condicional, tradicionalmente promovida en los acuerdos de libre comercio (ALC) de Estados Unidos. El análisis crítico de las disposiciones laborales del CPTPP se enfoca en torno a tres aspectos: la relatividad de su carácter novedoso, el contenido discutible de los estándares laborales y la conveniencia de la equiparación entre los mecanismos de solución de las diferencias en los ámbitos comercial y laboral.
