Abstract
The present article analyzes the qualification as "punitive" of Company Directors¿ liability in insolvency (172.3 LC), the legal technique with which the rule has been written up in this aspect, and the adjustment or not adjustment of the comparison of the liability in insolvency with others liability rules to which also the same punitive character has been attributed.
