Abstract
The resolution of the European Parliament of 12 September 2017 has revealed a series of shortcomings in the regulation of cross-border mediation nine years after the adoption of Directive 2008/52/EC of the European Parliament and of the Council of 21 May 2008, on certain aspects of mediation in civil and commercial matters (Directive on mediation). The objective of this paper is to analyse the causes of the lack of culture of cross-border mediation in the family environment from the perspective of European regulation and issues of private international law.
