Abstract
In the two years that the new Book II of the revised text of the Insolvency Act has been in force, one of the key issues in the field of preinsolvency law in general and of restructuring plans in particular has been the control of the plan to be carried out by the judge at the time of the approval and the scope of the judicial review. This is the core issue raised in Order No. 340/2024, of July 30, of the Commercial Court 16 of Madrid.
