Abstract

This paper is a version of the lecture given at the International Research Seminar on "Collective Bargaining and Corporate Groups" organized by the Centre de Droit Comparé du Travail et de la Sécurité Sociale (Comptrase-CNRS), Université Montesquieu-Bordeaux IV and held on 3 April 2009. Enterprise groups are a business reality. These phenomena are the result of processes of transformation in the world of economics. This new enterprise model is an example of the concentration of subsidiary companies and the downsizing of the production units that compose them. The development of enterprise groups generates many problems in the dynamics of labour relations and in the determination of collective employment and working conditions agreements. This report examines the essential features of group collective agreements, which enable the group to be identified as an employer. Thus, certain aspects of collective and individual employment relationships are discussed such as the legitimacy of collective bargaining, employee presentation within the group, the conditions of employment and work, and the modification and termination of labour contracts.
