Abstract

Most attempts of modernization of legal language carried out in different countries have incorporated the use of non-sexist writing, as one of the fundamental principles which cannot be waived. This should also be one of the premises in the modernization of legal Spanish, according to the author of this paper, who is a member of the National Committee for the Modernization of Legal Language of the Spanish Ministry of Justice. She discusses three reasons for her claim: accuracy and precision; equality; and legal imperative. On the other hand, non-sexist legal drafting cannot ignore the requirements of modern legal drafting: it should also be plain, clear and transparent.
