Résumé
The coming into force of the United Nations Convention on the Rights of Persons with Disabilities has settled a new way of facing traditional institutions in Spanish Law as guardianship and incapacitation, mainly about their regulation and practical effectiveness. This paper addresses a general review of this procedures, in order to determine to what extent they are affected by the UN Convention. The most remarkable dysfunctions are highlighted, to raise the need of reform to suit the inspiring principles and requirements of the new international legal frame.
