Resum
The legal concept of the worker is experiencing significant tensions. It can be maintain that it is derived towards a legal type that allows to extend labour rights to people that are not part of employment contracts, that are part of other labour relationships. A good example of the aforementioned tensions that affects the concept of worker is found in the case law issued by the Court of Justice of the European Union in order to guarantee the free movement of workers.
