Abstract

The eternal debate between security and privacy in order to control and prevent possible terrorist attacks in a globalised and technified world raises the question of whether massive surveillance systems used by public authorities are necessary in a democratic society and whether/if they have adequate guarantees to fulfill their objectives without infringing on the fundamental rights of the subjects concerned. The sentence/ judgment analysed here leaves a certain bittersweet taste, because despite condemning the United Kingdom for its massive surveillance systems, it does not openly condemn this type of measure.
