Abstract

The article starts by assuming that, in Economic Science, there is some consensus about the statement “competition is good for the market” given that encourages innovation, price reduction, and the efforts of companies to cut their production costs. Moreover, there is a consensus about the fact that, in order to protect compe- tition, regulations that prevent and correct practices against free competition must be established: non-competitive or anti-competitive practices and concentrations of companies that can exercise their power in the market. These consensus disappears when trying to establish who should be the body to develop such regulatory and/or competition functions and what organizational and functional characteristics must have. The main aim of this article is to deal with four basic questions referred to Regulation and/or Competition Agencies: the reason that justifies their existence; the need to enjoy the maximum level of independence and credibility; whether or not they should have a sectorial or multisectorial nature; and finally, if the deci- sion of merger regulation and competition funtions in a single agency, as has happened in Spain with the creation of the CNMC, is justified
