Abstract

Directive (EU) 2019/1023 of the European Parliament and of the Council of 20 June 2019 on preventive restructuring frameworks, on discharge of debt and disqualifications, and on measures to increase the efficiency of procedures concerning restructuring, insolvency and discharge of debt, and amending Directive (EU) 2017/1132 (Directive on restructuring and insolvency), published in the OJEU on 26 June 2019, marked an important step forward in the harmonization process in the field of insolvency. However, in the opinion of the European Commission, it does not represent the end of the harmonization process and it is necessary to move forward along this path with the aim of eliminating obstacles to the proper functioning of the internal market. In these lines, we will address the main points where, in the Commission's opinion, it is essential to tackle new reforms in the near future.
