Abstract

This article compares the Insolvency Law of Brasil and the Spanish one. It focuses on the analysis of the Law for recovering firms, based mainly in public and collective interests. The main purpose of the Spanish Insolvency Act seeks paying the creditors instead of recovering the firm. Another important difference with the brasilian Law is that the Spanish insolvency procedure applies to all debtors, not only to companies.
