Résumé

This analysis is carried out taking into account the latest trends in the commercial landscape characterized, among other aspects, by the negotiation and adoption of “megaregional” agreements. According to the legal scholars’ doctrines, one of the characteristics of these agreements is their broad scope of contents including commitments in respect of investment, environment and labour rights. The present contribution focuses on a comparative analysis of the labour chapters of the two free trade agreements (FTA) of the “latest generation”: the Trans-Pacific Partnership (TPP), which entry into force has been paralyzed due to the trade policy changes of its mayor Partner the United States of America (USA), and the Comprehensive Economic and Trade Agreement between the European Union and Canada (CETA) recently approved by the European Parliament. However, from the theoretical point of view, it seems interesting to contribute to the discussion on the current models of social clauses by comparing two different approaches promoted respectively by the European Union in the framework of the CETA and by the USA under the TPP. In this sense, it has been compared the content of the social clause, namely the labour rights that are protected, and the control mechanisms to ensure the effective protection of these rights within the two normative systems.
