Tools such as Artificial Intelligence (AI), which drink from our personal data, have been installed in our lives to make them easier, but at the same time they have brought new threats to our rights, especially to the right to data protection. This has been seen, in the so-called «Replika» case, by the Italian Data Protection Authority which has ordered the suspension of the processing of personal data by an AI application (app), a chatbot, where minors were involved. We explain here his reasoning, as well as the implications of the use of AI in the fundamental right to the protection of personal data, having as a legal framework of reference the proposal for a future European AI Regulation.
