Abstract

The heavy influx of asylum seekers in recent years in the European Union has clearly exposed the shortcomings of the Common European Asylum System. The EU remains one of the main destinations for migratory flows from around the world, but reflects an unstable legal situation reflecting a marked lack of coordination between Member States despite numerous efforts since 2016. The penultimate step came on 8 June 2023, when EU interior ministers met in Luxembourg to discuss massive cuts in European refugee rules and agreed on a common position on two central elements of the EU Pact on Migration and Asylum: the mandatory introduction of border procedures and a solidarity mechanism full of loopholes. The agreement is based on the purported consensus of EU states that defence and isolation have priority and on the verification of whether they are willing to uphold the rule of law while respecting refugee protection and human rights. However, the reform project does not seem fit for purpose.
